So we were asked, “What happens if my visa application is refused?”
Hi, this is Michael Niren, an immigration lawyer and a founder of VisaPlace.com. This is a very common question. We get asked this question a lot, and I can answer it this way. If your application was refused, it doesn’t necessarily mean that’s the end of the road. It does happen frequently.
Reasons for Visa Refusal
There are many reasons for refusals. I’ll just list a few. The application wasn’t handled properly initially. You perhaps chose the wrong visa. There’s a lot of choices, and when you apply for immigration or visa to Canada and United States, there are many different types of visas, and you may have just picked the wrong one. There could have been a miscommunication with the governments. Your application could be fine, but there is some misunderstanding on the part of the government, and as a result, they refuse your application.
What to Do If Your Visa Is Denied
So there are different ways to respond to a refusal. One is a formal appeal if that’s appropriate. Now, an appeal has to be filed on time, there are always deadlines for appeals. But if an appeal is not appropriate, you could always reapply, depending upon the circumstances or as I mentioned, if the visa is incorrect, you may have to apply for the correct visa. The key is to try to get it right the first time.

The right questions are asked, and the immigration professional really understands the circumstances, so he or she can guide you towards the right path, in terms of what visa you need, and what’s it gonna take to get an approval. That’s the most important part of the journey, the first step.

So we get a lot of people coming to us who, unfortunately, have had they visas refused, and we try our best to help, and in many cases, we can succeed and help them. But my advice to you is before you take that first step, consult with an immigration professional who knows what they’re doing, so you won’t have to face a refusal or at least, the chances of getting refusal are minimized.
